Creator Content, Consent & Performer Agreement

About This Agreement

This Agreement governs all content submitted, created, streamed, sold or otherwise made available by a creator through X-Stream Cams. It forms part of the Terms of Service and must be accepted before creator approval.

1. Parties and Acceptance

This Agreement is between X-Stream Cams Ltd ("X-Stream", "we", "us" or "our") and the person applying for or operating a creator account ("Creator", "you" or "your").
By selecting the mandatory acceptance box, submitting verification materials, uploading content or using creator services, you confirm that you have read and agree to this Agreement.
Acceptance should be recorded with the Creator account ID, agreement version, date, time and relevant technical audit data.

2. Scope of Content

"Content" includes livestreams, private shows, video, audio, photographs, profile material, thumbnails, messages, digital downloads, promotional material and any other media supplied through the platform.
This Agreement applies whether Content is free, paid, subscription-based, token-based, public, private, scheduled, recorded or live.

3. Adult Status and Identity Verification

You confirm that you are at least 18 years old and legally able to enter into this Agreement.
You must complete X-Stream identity and age verification before publishing, selling or streaming Content.
Verification may include government-issued photographic identification, liveness or selfie checks, document matching and a dated photograph holding your identification.
You must provide accurate, current and authentic information.
You must not allow another person to use your verified creator account or verification materials.
We may require repeat verification where information expires, changes, conflicts, appears unreliable or is needed for a compliance review.

4. Co-Performers and Other Persons

Every person appearing in Content must be at least 18 and separately verified and approved before that Content is uploaded, streamed or published.
You must ensure that each co-performer gives informed, specific and freely given consent to appear and to the intended recording, publication, sale and promotion of the Content.
An assurance from the uploading Creator alone is not sufficient. You must use the platform process for co-performer identification, age verification and consent, and provide additional releases or records when requested.
You must not tag, identify or submit another person as a co-performer without their knowledge and permission.

5. Consent and Control

You confirm that participation in every item of Content is voluntary and free from force, threats, fraud, pressure, intoxication that prevents meaningful consent, trafficking, exploitation or abuse.
Consent to one act, recording, audience, platform or use does not imply consent to a different act or use.
You may report a consent concern or request review of future availability by emailing compliance@x-streamcams.com .
X-Stream will assess the request promptly and may restrict Content while it is reviewed.

Withdrawal of consent may prevent future availability but may not undo lawful processing, completed customer access, accounting, evidence preservation or other actions already undertaken before the request.

6. Ownership and Licence

You retain ownership of Content you lawfully own.
You confirm that you own the Content or hold every permission, licence, release and intellectual-property right required to use it on X-Stream.
You grant X-Stream a non-exclusive, worldwide, royalty-free licence, for as long as reasonably required to operate the service and honour lawful transactions, to host, store, reproduce, encode, transmit, display, distribute, moderate, protect and make the Content available through the platform.
You also permit X-Stream to use approved excerpts, thumbnails and profile materials to promote your X-Stream profile and the platform, subject to your settings, applicable law and any specific written arrangement.
You must not upload stolen, pirated, leaked or unlawfully copied material, or material that infringes privacy, publicity, contractual or intellectual-property rights.

7. Prohibited Content and Conduct

Strictly prohibited: Content involving, depicting or appearing to depict a person under 18, including age-play or presentation intended to suggest that a performer is a child.

Content involving coercion, trafficking, exploitation, non-consensual activity, hidden recording, revenge pornography, incest, bestiality, necrophilia, serious violence, sexual assault or other unlawful conduct is prohibited.
Content involving a sleeping, unconscious or materially incapacitated person is prohibited unless the context is lawful staged roleplay between verified adults and prior consent is documented; X-Stream may prohibit such material regardless.
You must not publish personal information without authority, threats, harassment, doxxing, hate content, scams, malware, unlawful goods or instructions facilitating criminal conduct.
Synthetic, altered or AI-generated material must not impersonate a real person without explicit authority and must comply with platform labelling requirements.

8. Livestreaming Rules

Only verified and approved adults may appear during a livestream or private show. An unverified person must not enter the camera or audio environment.
You must control the streaming location, protect private information, and end the stream immediately if an underage, unverified, non-consenting or distressed person appears.
Livestreams must comply with this Agreement, the Terms of Service, token rules, applicable law and moderator instructions at all times.

9. Record Keeping and Cooperation

You must cooperate with reasonable identity, consent, rights, complaint, chargeback and regulatory enquiries and provide requested records within the stated timeframe.
X-Stream may maintain verification, consent, content-reference and audit records to meet legal, safety, payment and compliance obligations, including requirements relevant to 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 where applicable.
You must not falsify, alter, conceal or destroy records relevant to a compliance investigation or legal preservation request.

10. Moderation, Reporting and Removal

X-Stream may review, restrict, suspend, refuse, preserve or remove Content where it may breach this Agreement, platform rules, payment requirements or law.
Reports involving minors, coercion, trafficking, non-consensual Content or immediate danger receive priority.
Relevant information may be preserved and disclosed to competent authorities where lawful and necessary.

11. Earnings, Tokens and Refunds

Creator earnings are calculated under the applicable payout terms and account offer.
Tokens are closed-loop platform credits and are governed by the X-Stream Tokens Purchase, Wallet, Refund and Chargeback Policy.
X-Stream may withhold, reverse or adjust sums reasonably connected with fraud, chargebacks, unlawful Content, duplicate payments, sanctions, breach of this Agreement or a compliance investigation, subject to applicable law and the platform terms.
The first 100 eligible Founder Creators accepted under the published promotional offer receive an 80% Creator share and a 20% platform share, subject to the Founder Creator terms and continued compliance.

12. Privacy and Confidentiality

Verification records are not displayed publicly and are restricted to authorised processing for safety, legal, payment and compliance purposes.
Your public stage name may differ from your verified legal identity.
You must not disclose another person's private or verification information.
Personal information is handled under the Privacy Policy.
No public stage name guarantees complete anonymity where disclosure is lawfully required.

13. Suspension and Termination

X-Stream may suspend or terminate creator access for material breach, suspected illegality, safety risk, failed verification, payment abuse or refusal to cooperate with a lawful compliance review.
Where appropriate, we will provide reasons and an opportunity to appeal.
Immediate restriction may occur where necessary to protect a person, preserve evidence, satisfy a payment partner or comply with law.

14. Creator Warranties and Responsibility

You warrant that all information you provide is accurate.
You warrant that all performers are verified adults.
You warrant that all necessary consent and rights exist.
You warrant that the Content and your conduct comply with law and this Agreement.
You are responsible for your Content and creator activity.
Nothing in this Agreement excludes rights or liabilities that cannot lawfully be excluded.

15. Changes to This Agreement

We may update this Agreement to reflect legal, regulatory, safety, payment or service changes.
Material changes will be dated and communicated appropriately.
We may require renewed acceptance before further creator activity.
The version accepted by the Creator will be retained in the platform audit record.

16. Governing Terms and Contact

This Agreement is governed by the laws of England and Wales, subject to any mandatory rights or rules that apply in another jurisdiction.
It should be read with the Terms of Service, Privacy Policy, Cookie Policy, Age Assurance Standard, Complaints and Appeals Policy, Token Policy, 2257/2257A Record-Keeping Statement and Creator Care, Safety and Support page.

Mandatory Creator Acceptance

I confirm that I am at least 18, that my identity has been truthfully verified, that I have read and agree to this Creator Content, Consent and Performer Agreement, and that every other person appearing in my Content will be separately verified and will have provided valid recorded consent before publication or streaming.

This operational agreement is intended for platform use and should be reviewed periodically by appropriately qualified legal counsel.
